Professional Discipline/Complaint (Q27-28)

 

The Character & Fitness section asks six different questions ranging from professional misconduct records, bad behavior, to mental health diagnoses. This guide will include instructions on Q31 about "Condition or Impairment" in the next tab. The first two questions in this section will ask if you have ever been suspended, censured, or otherwise reprimanded or disqualified as a member of another profession, or as a holder of public office? You will be expected to have a copy of the associated action or complaint and provide an explanation. See below:

If you need assistance finding the dates for licenses you have obtained first look to the agency that provides the license or the county/city that provided it. Another option may be to look to your LinkedIn or an old resume if you recorded your licenses and certificates during job searches. 

Bond (Q29)

The application asks if "any surety on any bond on which you were the principal been required to pay any money on your behalf?" The answer may be short depending on your history. At this point, your application should appear like the screenshot below:

NOTE: Per the NCBE, bail bond transactions do not need to be reported unless you failed to appear in court and the bonding company had to pay a forfeiture due to the non-appearance. 

Conduct or Behavior (Q30)

For this question you need to provide a full list of conduct/behavior, like school or employment discipline, and criminal/civil actions, that might "call into question your ability to practice law in a competent ethical and professional manner." The application asks that you record all such behavior from the past five years.

Include all previous incidents that you may have already discussed in other parts of this application like employment discipline. This section gives you an opportunity to explain what happened and upload any supporting documents. The required documents to upload in this section are any of the following that apply (PDF format preferred):

  • Unauthorized Practice of Law
  • Sanction or Disqualification
  • Military Service
  • Professional Discipline
  • Professional Complaint
  • Civil Action
  • Administrative Action
  • Criminal Action

  • Defaulted Student Loan

  • Bankruptcy
